NUBSNL RULES ON HBA HYPOTHICATION

 Office Memorandum

 Subject: Grant of House Building Advance Procedure for mortgaging of property by BSNL Staff.

             I am directed to refer to letter No: HBA-40-1/REGS/9B/PT dt. 19.4.2001 of the o/o CGM, KERALA telecom Circle on the subject noted above and to say that Management Committee of the BSNL Board has considered the matter regarding procedure to be followed by the BSNL Staff for mortgaging the immovable property acquired by availing House Building Advance and have decided the procedure for mortgaging the property constructed/acquired by availing House Building Advance as hereunder: -

 1.(I)     Procedure for the mortgaging property in respect of those employees who are on deemed deputation in BSNL.

 (i)                 The procedure for mortgaging of property in respect of deemed deputationists in BSNL may continue to be regulated by the existing provisions of House Building Advance Rules of government of India as applicable to Central Government employees. The mortgage shall be in the name of President of India.

(ii)                 The authority in Circles/Districts in BSNL Competent to sanction House Building Advance may issue a certificate to the concerned employee to the effect that he or she is an employee of government of India and on deemed deputation in BSNL. Issue of such certificate has been necessitated for the fact that Registrar Offices in States of Union of India ;may not have any doubt about the present status of the employees in BSNL.

 1.(II)            Procedure for mortgage of property in respect of those employees who have been absorbed in BSNL or directly recruited in BSNL.

             In case of such employees the procedure of Equitable Mortgage by deposits of Title Deeds may be followed. A copy of the procedure along with relevant proforma is enclosed.

 2.                  Custodian of Title Deeds:

 (i)     It has further been decided that the Heads of Circles etc. may designate one officer fro administration side as custodian of the title deeds (mortgage papers etc.)in case of both categories of employees in BSNL.

It has also been decided that Asstt. Director General (Pers.II)    under Sr. Deputy Director General (Pers.) is designated custodian of the aforesaid documents in respect of employees working in BSNL Corporate Office.

       This issues with the concurrence of Director (Fin) vide Dy. No.1450 dt. 5.3.2002.
